Al Ansari Wallet, developed by Al Ansari Digital Pay L.L.C (“AADP), a subsidiary of Al Ansari Financial Services P.J.S.C, licensed and regulated by the Central Bank of the UAE (CBUAE) is a digital wallet designed with the unbanked user in mind, offering a secure, user-friendly environment for seamless peer-to-peer transfers, international remittances, merchant payments, bill payments, and a range of digitally enabled services. Fueled by a commitment to financial inclusion and the government’s ‘cashless society’ initiative, Al Ansari Wallet empowers users with the tools to make informed financial decisions, providing easy access to funds and transaction history. This wallet is not just a platform but a testament to Al Ansari Financial Services’ dedication to leveraging state-of-the-art technology for essential financial services, ensuring a secure and efficient platform for the evolving needs of its users.

 

Please read these Terms and Conditions carefully before using Al Ansari Wallet. By clicking accept, you acknowledge that you have read, understood and agree to be bound by these terms and conditions. 1. Regulatory status

Al Ansari Digital Pay L.L.C is licensed and regulated by the Central Bank of the UAE (CBUAE). Its registered office address is Al Ansari Business Center, Level 8, Al Barsha, P.O. Box – 6176, Dubai, United Arab Emirates.

 

2. Definitions and terminologies

The following words and phrases have the meaning set out below unless the context indicates otherwise: 

 

  • AADP, WE: Al Ansari Digital Pay LLC
  • AAW: Al Ansari Wallet
  • Customer, You or User: Individual, who uses the Al Ansari Wallet.
  • P2P: Peer to Peer(wallet to Wallet Transfer)
  • KYC: Know your customer (KYC) refers to due diligence activities conducted by AADP as per regulatory requirements to ascertain the relevant information of the customer/sender.
  • ICP: Federal Authority for Identity, Citizenship, Customs & Port Security
  • RPSCS: Retail Payment Services and Card Schemes 
  • SVF: Stored Value Facilities 
  • AML: Anti Money Laundering
  • CFT: Combating the Financing of Terrorism
  • Payroll & PayPlus Cards: These are salary cards issued by Al Ansari Exchange under the CBUAE Wage Protection system (WPS).

 

3. These Terms apply to your use of:

  1. AADP services, which includes regulated financial services such as P2P (wallet-to-wallet) money transfers, international remittances (Powered by Al Ansari Exchange – Terms and Conditions – Al Ansari Exchange | Privacy Policy – Al-Ansari Exchange (alansariexchange.com), bill payments and a range of digitally enabled services; 
  2. AAW App: (Android/IOS); 
  3. AAW website: www.alansariwallet.com.

 

4. Acceptance of these Terms

To access AADP services, you should download the AAW App and you are requested to read and agree to our Privacy Policy and these Terms. We advise you to save a copy of both Privacy Policy and these Terms for your records.

 

By installing, accessing or using the AAW App or its services, you agree to adhere to and be bound by these Terms.

 

We may update these Terms or modify the AADP services from time to time. You will be notified via email or push notification or the AAW App, or our website (www.alansariwallet.com) and also a pop-up message will be sent to you, where your consent will be recorded. Any changes limit your rights or increase your obligations, we will notify you at least 30 Calendar days prior to the changes taking effect. Other updates will become effective immediately upon notification. 

 

If you disagree with any of our changes to the Terms, you must immediately stop using the AAW account or services with us. By continuing to use the AADP services after any changes to these Terms, you then agree to abide and be bound by those changes.

 

We may also request your acceptance of additional terms and conditions for new services, which will be communicated through the AAW App.

 

In the event of a breach of these Terms, we reserve the right to disable your AAW account and block your access to our services immediately. You will neither be allowed to create a new account, nor access the AADP services, without our permission.

 

4.1 Registering on the Al Ansari Wallet (AAW)

4.1.1 Eligibility for using AAW

  1. You should be at least 18 years of age. 
  2. You should be a resident in the UAE with a valid Emirates ID issued by ICP.
  3. You should have a UAE registered mobile number.

 

4.1.2 Registration Requirements

Registering on AAW requires the following conditions to be met:

  • You are required to provide any documentation we request to verify your identity through the AAW App, including but not limited to your Emirates ID, phone number, eKYC details, and a facial image for liveness verification. All information provided must be accurate, complete, and up to date. You agree to promptly notify us in writing of any changes to this information.
  • Read and agree to the Terms and Conditions listed on the AAW App.

 

  • To access AADP services, you should download the AAW App and you are requested to read and agree to our Privacy Policy and these Terms. We advise you to save a copy of both the Privacy Policy and these Terms for your records.

 

  • By installing, accessing or using the AAW App or its services, you agree to adhere to and be bound by these Terms.

 

  • We may update these Terms or modify the AADP services from time to time. You will be notified via email or push notification or the AAW App, or our website (www.alansariwallet.com). If the changes limit your rights or increase your obligations, we will notify you at least 30 days prior to the changes taking effect.   • In the event of a breach of these Terms, we reserve the right to disable your AAW account and block your access to our services immediately. You will neither be allowed to create a new account, nor access the AADP services, without our permission.
  • We reserve the right to decline your request for an AAW account or impose limitations on available features, functions, or services. 

 

  • Activation of the AADP service for online transactions is subject to approval by our AML and Compliance Department, in accordance with internal policies and applicable AML and CFT laws and regulations. Applications for activation may be denied due to incomplete or inaccurate information or documentation, and for reasons related to compliance with AML policies and procedures. Any subsequent changes to your profile will be subject to verification and approval.
  • You will be required to create a unique wallet PIN code to access your AAW account and services. You are solely responsible for maintaining the confidentiality and security of your PIN. AAW will not be liable for any unauthorised use of your account using your PIN code.
  • Biometric Authentication is used solely to secure authentication and verification, prevent unauthorized access and protect your account and transaction information. Biometric data includes Facial recognitions & Fingerprint scans.

 

4.2 Usage of Your Personal Data:

The personal data will be used in accordance with applicable laws and our regulatory obligations. We request you to read our Privacy Policy to understand the usage of your personal data. Privacy Policy

 

4.3. Features of Al Ansari Wallet

AAW App offers various services and features not limited to those listed below. AADP reserves all the rights to make changes to the services and features at any time without prior notice or consent from you. For the latest features, you are advised to check the website.

4.4 Fees and Charges for Transactions

The fees and charges for transactions are displayed at the time of initiating a transaction. VAT applicable on the transactions is also displayed. By proceeding with the transaction, it is understood that you have agreed to the applicable charges for the transaction. 4.5 Notifications

AADP may send specific and timely notifications via email, pop-up screen on your mobile device, web browser or SMS. You acknowledge that notifications may be delayed or prevented due to factors beyond our control, such as network issues, technical difficulties, or service provider limitations. We cannot guarantee the delivery, timeliness, or accuracy of notifications. We will not be liable to you for any losses, damages or expenses arising from:

  1. Non-delivery, delayed delivery or wrong delivery of a notification.
  2. Inaccurate or incomplete content of a notification.
  3. Use or reliance by you on the contents of an alert for any purpose.

 

4.6 Remittance Transactions

  1. Account and transaction activity in relation to the AADP services for suspicious or illegal activity are reviewed in accordance with our regulatory AML requirements. 
  2. AADP retains the right to amend the terms and conditions to comply with local laws or internal policies. Customers will be informed of any such changes via the website, or through other electronic channels.
  3. We reserve the right to reject your request for an AAW account, or place limits on which features, functionalities and/or facilities are available to you as part of the AADP services, including limits on your transactions. 
  4. Important Notice: You will be required to create a unique wallet PIN code to access your AAW account and services. You are solely responsible for maintaining the confidentiality and security of your PIN. AAW will not be liable for any unauthorized use of your account using your PIN code.
  5. Important Notice: AADP customers must maintain sufficient balance before availing any services. Insufficient funds in the wallet may result in failure of transaction.
  6. AADP reserves the right to suspend or terminate the access to the wallet if conduct is found to be unsatisfactory or against the AADP’s Compliance Policy, the CBUAE’s regulations, or the AADP’s Terms and Conditions.
  7. Important Notice: For all AADP services, we reserve the right to delay and investigate the execution of a transaction (including placing any funds on hold) where:

    1. The required information to execute the transaction and/or any additional information we have requested about the transaction are not provided. 
    2. The applicable laws prohibit the transaction from being executed. 
    3. The transaction is believed or suspected to be fraudulent or related to any criminal activity.
    4. The terms are breached in any manner, or the carrying out of the transaction would result in such a breach.
    5. A third party (service provider) prevents us from making the payment.

 

4.7 Bill Payments

  1. Bill Payments may have additional charges and would be intimated at the time of the transaction.
  2. Important Notice: Bill Payments are not instant payments and may take 1-2 working days for the selected institution to receive the payment.
  3. Important Notice: AADP is not liable for any damages or penalties incurred by the sender as a result of paying the bill through AAW App. The responsibility of AADP is to process the transaction as per the details provided by the sender upon receiving fund confirmation.

 

4.8 Linking of Al Ansari Exchange WPS Account to Al Ansari Wallet Account

WPS Payroll Account: The account, maintained with Al Ansari Exchange, serves as the designated payroll account for the purpose of processing salary transfers via the Wage Protection System (WPS). It accommodates both Payroll and PayPlus Cards.

  1. By linking your Wage Protection System (WPS) account, you hereby grant authorisation to Al Ansari Digital Pay to access and manage your WPS account maintained with Al Ansari Exchange for the purpose of facilitating transactions, fund transfers, and card management in accordance with your electronic or online instruction via the Al Ansari wallet. You acknowledge and accept full responsibility for all transactions conducted by utilising your linked WPS account.
  2. By linking the WPS account, AAW holder will acquire the right to access a card management option that will allow the account holder to manage their PayPlus card with the following features. It is your responsibility to safeguard your login credentials to avoid any misuse in the card management.

  3.  Important Notice: By accepting the Terms and Conditions, you hereby grant Al Ansari Digital Pay the authority to disclose relevant information to third-party service providers for the purposes of verification and transaction processing.
  4. You hereby acknowledge and accept your obligation to maintain the confidentiality of your login credentials associated with both your Wallet Account and your secondary WPS account. Furthermore, you agree to promptly notify us of any unauthorised access to your accounts or any other breach of security that may occur.
  5. Al Ansari Digital Pay / Al Ansari Exchange shall not be held liable for any unauthorised access to or utilisation of your accounts resulting from your failure to safeguard your login credentials.
  6. Al Ansari Exchange reserves the right to impose restrictions on the amount of funds that may be transferred from your Wage Protection System (WPS) account to your AAW Account.
  7. You may terminate the linkage of your WPS account at any time by submitting a formal request to either Al Ansari Exchange or ADDP via email or branch visit.
  8. Al Ansari Digital Pay hereby reserves the right to unbind your WPS account or terminate your access to this feature at any time and for any reason, which may include, but not limited to, the suspicion of fraudulent activity.
  9. Important Notice: To the fullest extent permitted by UAE law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the linking of your WPS account to your wallet or from any transaction conducted thereafter.
  10. Al Ansari Digital Pay hereby reserves the unequivocal right to amend these Terms and Conditions at any time, at its sole discretion. Any amendments shall be duly communicated to users, and the continued use of the linked WPS account feature shall constitute unequivocal acceptance of said amended Terms.

 

4.9 Merchants: 

The user can view all merchants, their information and their locations nearby.  To access the merchant’s location, the user must allow permission to share the customer location by clicking on the merchant’s button located on the bottom bar of AADP.

 

4.10 Blocking Your AAW Account:  

We reserve the right to block your AAW account or services based on the following instances.

(a) Instruction by the CBUAE or as required by law enforcement authorities. 

(b) To comply with a court order. 

(c) To recover unpaid fees owed to us. 

(d) Evidence of dishonest, fraudulent, or criminal activity. 

(e) Evidence of death.

We reserve the right to seize funds in compliance with a court order, instruction from the CBUAE, law enforcing authorities or legal processes, and/or reverse a transaction.

 

4.11 Erroneous Transactions: 

Important Notice: AADP will not be liable for any loss or costs incurred upon acting on your instructions. Such losses will be incurred and borned by Customers.

 

4.12 Refunds: 

Important Notice: Refunds for transactions made with your AAW account will be processed to the customer’s used wallet within 2 business days. When you make a purchase using your AAW account and the transaction is ultimately refunded due to any glitch, the payment will be refunded to the same payment method you used for the transaction.

 

4.13 Wallet Account Security and Unauthorised Transactions: 

4.13.1 You must take all reasonable precautions to keep the device, AAW account, and security information such as PIN code, login credentials and password secure to prevent any fraud, misuse or unauthorised transactions. All transactions are secured with two-factor authentication (2FA). Additionally, the customer will also log in via their mobile number and wallet PIN. 

4.13.2 If your AAW account login details are lost, stolen, or compromised, or if you suspect that the account has been cyber attacked/hacked, you must immediately contact our call center 600506005 or email us at [email protected]. 

4.13.3 If you suspect any unauthorised transactions from your AAW account, or any unrecognized or incorrect transactions in the statement, you must report to us immediately by contacting our call center 600506005 or email us at [email protected], and no later than 30 business days from the transaction date. We will inform you of your options to mitigate any further risks associated with the account. 

 

4.14 Intellectual Property

Other than expressly provided for in this T&C, you shall not directly or indirectly reproduce, copy, alter, edit or otherwise modify or make or cause to be made any imitation of the technology or , attempt to acquire any rights in connection with the Trademarks or other intellectual property of us. The use by Licensee of the Trademarks shall not in any way create in Licensee any right, title or interest in or to the trademarks or any of the intellectual property of us

 

4.15 Limitations on the Usage: 

4.15.1 The user agrees not to reproduce, duplicate, copy, imitate or re-sell all or any part of the AADP services, the AAW App and/or the website www.alansariwallet.com and any content thereon, without obtaining prior written consent from Al Ansari Digital Pay (AADP). 

4.15.2 The user agrees not to use the AADP services, the AAW App and/or the website www.alansariwallet.com:

  1. The intentional transmission, sending, or uploading of any data or material containing malicious software, including but not limited to viruses, Trojan horses, worms, keystroke loggers, spyware, adware, or any other harmful programs or code designed to impair the functioning of any computer software or hardware, is strictly prohibited.
  2. To access or purchase goods from adult or gambling locations or websites, or for any other unlawful activity or other restricted merchants as applicable; 
  3. In any way that breaches any applicable local, national or international law or regulation; and/or
  4. In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect. 

 

4.16 Disclaimer:

To the extent permitted by applicable laws: 

  1. We provide the AADP services, the AAW App and the website www.alansariwallet.com, and any content on the App and the website, on an “as is” and “as available” basis;
  2. We do not provide any warranties or guarantees, whether express or implied, regarding the accuracy, completeness, or usefulness of the information provided, nor do we guarantee that the AADP services, the App, or the website will be operational, error-free, secure or without disruptions or delays;
  3. We shall not be held accountable for any issues arising from your use of the AADP services, the AAW App, and/or the website.

 

4.17 Liability

You irrevocably and unconditionally acknowledge and agree that:

  1. Any transaction that originates from your AADP using your User ID and Password/PIN, whether initiated by you or not, will be deemed to have originated from you.
  2. You will be liable for all loss from unauthorised transactions if your credentials are compromised and will not hold AADP liable for any loss that you may suffer as a result.
  3. Illegal or improper use of AADP by you or any other person will result in suspension of your account.
  4. You are aware that the internet/email is not a secure or error-free medium of communication and of the possible risks involved in the transmission of information via email/internet.
  5. You are aware that universally it is understood that there is no way to verify that technologies are foolproof or tamperproof and/or to keep up with the latest technology available at any particular time.
  6. You understand and agree that AADP does not accept liability for any errors or omissions in the content of the email messages and its attachments. You undertake to keep us indemnified at all times against and to save us harmless from all actions, proceedings, claims, loss, damage, costs and expenses including consequential losses/damages, which may be brought against us and which will have arisen either directly or indirectly out of or in connection with us sending account statements and other documents via email.

 

4.18 Termination and Closure of Al Ansari Wallet Account: 

4.18.1 We reserve the right, at any time and for any reason, to close your AAW account. 60 calendar days’ notice for closure of account will be provided via SMS, email or the AAW App.

4.18.2 You may request to close your AAW account at any time and for any reason by contacting us through our Contact Page or via the AAW App. A final account statement will be issued within seven business days of receiving your request and upon closure of account. Alternatively, you can email us at [email protected].

4.18.3 If there are remaining funds in your account, you will be required to utilise the balance or cash out at any Al Ansari Exchange branch.

4.18.4 These Terms will automatically terminate once your AAW account has been closed. 

4.18.5 For closure of your AAW account you will receive a written confirmation that your account has been closed or deactivated. 

4.18.6 If you owe any outstanding balances, we reserve the right to keep your AAW account open until the amount is recovered or settled.

4.18.7 In case you lose access to your mobile phone or if your mobile number is reassigned to another user, your AAW account will be inactivated. To reclaim access, you will be required to provide an original Emirates ID and a valid mobile number. You can either:

  1. Register a new account and retrieve the previous account to continue using AADP services; or
  2. Register a new account, retrieve the previous account, redeem any remaining balance and terminate the service.

4.18.8 If no transactions are performed on your account for one year (or a period specified by AADP, subject to applicable laws), your account will be considered dormant. You will be notified, and we may reject transactions or restrict access to the dormant account. Please contact us via the AAW App, our Customer support, or email us at [email protected] to reactivate your dormant account or claim funds.

 

4.19 General: 

4.19.1 These Terms, as amended from time to time in accordance with the provisions contained herein, together with any other documents referenced or linked to these Terms (including but not limited to the Privacy Policy), constitute the entire agreement between you and AADP regarding your use of the AADP services, the AAW App and/ or the website. 

4.19.2 AADP’s delay or failure to act following any breach by you of these Terms shall not prevent us from exercising our rights or remedies at a later date. Any attempt by you to waive any of these Terms is not permitted without our prior written consent.

4.19.3 These Terms do not give any third party any rights, meaning they are only enforceable by you and us. 

4.19.4 If any provision of these Terms is deemed illegal or unenforceable, then that provision shall be deemed severable from our Terms and shall not affect the validity and enforceability of the remaining provisions. 

4.19.5 Any notice you are required to give us under these Terms should be sent to our Contact Page or emailed to us at [email protected]. Any notice we are required to give to you may be sent to you via an outbound call, the AAW App, our website www.alansariwallet.com and/or to the email address or mobile number linked to your AAW account. 

4.19.6 You will comply with all applicable laws and regulations with respect to the AADP services in the UAE and in the country of use.

 

4.20 Transaction History

As part of the AAW App offering, Transaction History will be available for viewing purposes. However, this is provided for reference only and should not be considered legal proof of transactions. The transactions listed may not be comprehensive or completely accurate due to differences in customer profile information during the course of the customer relationship with AADP. You must make a formal request to the AADP for a statement of transactions made at AAW.

 

4.21 Login Credentials and OTP

  1. AAW requires a login, with the login credentials set up by you, to start the services. One-Time Passwords (OTPs) are implemented at critical places to ensure control over access and activity on the mobile application.
  2. You are responsible for the confidentiality and use of your login credentials and OTP. You must not disclose your login credentials or OTP to any third party, and must not authorise any third party to use your profile for any purpose whatsoever. You agree to take reasonable measures and due care to protect your login credentials against misuse by third parties. As a means of precaution, you understand that it is recommended to change the login credentials at periodic intervals.
  3. You must notify AADP immediately if you have knowledge or have reason for suspecting that the confidentiality of your login credentials has been compromised or if there has been any unauthorised use of your digital profile (such as where you notice any unauthorised transactions or unauthorised access to your accounts) or your login credentials have been disabled after a number of incorrect password attempts.

 

4.22 Profile Inactivation/Closure

AADP has the right to inactivate the profile of a customer without any intimation, due to an untimely response or insufficient or inaccurate information provided by the customer and matters related to AML Compliance Policies and Procedures of AADP. AADP will not be liable for any consequences arising out of such inactivation. Any transaction in process at the time of profile inactivation will be processed as per the terms and conditions associated with the said service. A customer can request the inactivation or closure of his/her profile submitting a formal request through the AAW App, Customer support & email.

 

4.23 Security Issues, Software and Hardware

You must maintain and update/upgrade all software, hardware and/or equipment, as applicable from time to time, to avail, access and use the services of AADP and be compatible with AADP at your own risk. You undertake to ensure that mobile phones you use to access AADP are free from malware, viruses, Trojans or other internet contaminants. AADP may change, vary or upgrade its software, hardware or operating systems at any time. We are not obligated to support your software or hardware, and it is your sole responsibility to ensure compatibility. AADP will not be liable for any losses that may be suffered by you as a result of any incompatibility between the service software and mobile phone from which you may use to access the service or non-use of the Service due to such incompatibility issues. The digital platforms are provided “as is” without any warranties of any kind. To the fullest extent permissible under applicable laws, AADP disclaims all such warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, freedom from errors, suitability of content or availability.

You agree not to engage in any of the following activities: 

  1. Copying, distributing, or disclosing any part of the platform in any medium, including, without limitation, any automated or non-automated “scraping”.
  2. Using any automated system, including, without limitation “robots,” “spiders,” “offline readers,” etc., to access the digital platform in a manner that sends more request messages to the servers than a human can reasonably produce in the same period of time.
  3. Transmitting spam, chain letters, or other unsolicited email.
  4. Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the platform.
  5. Taking any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure.
  6. Uploading invalid data, viruses, worms, or other software agents through the platform.
  7. Collecting or harvesting any personally identifiable information from the platform.
  8. Using the platform for any commercial solicitation purposes.
  9. Impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, or hiding or attempting to hide your identity.
  10. Interfering with the proper working of the platform, including tampering with or attempting to alter the application in any form.
  11. Accessing any content on the site through any technology or means other than those provided or authorised by the platform.
  12. Bypassing the measures we may use to prevent or restrict access to the platform, including, without limitation, features that prevent or restrict use or copying of any content or enforce limitations on use of the platform or the content therein.

 

4.24 Record Maintenance

AADP will maintain records of transactions, KYC information, customer feedback or complaints as mandated by the law and regulations. AADP has an obligation to retain your data for a minimum of five years after you cease to be a user or from the date of the transaction. The period of retention for such records will be in the sole discretion of AADP as per statutory regulation or our internal policy. You hereby agree that you will not challenge or dispute the admissibility, reliability, accuracy or authenticity of the contents of such records merely on the basis that such records were set out in electronic form, and you hereby waive any rights to object.

 

4.25 Accuracy of information

You will be responsible for the correctness of information supplied by you to AADP through the AAW or through any other means such as electronic mail or written communication. AADP accepts no liability for the consequences arising out of erroneous, incorrect or incomplete information supplied by you. If you suspect that there is an error in the information supplied by you, you will advise AADP as soon as possible. AADP will endeavor to correct the error wherever possible on a ‘best effort’ basis. 

 

4.26 Data Processing

AADP places utmost importance on the privacy and protection of clients and considers this to be a critical part of the services rendered. You hereby consent to AADP’s collection, use, disclosure and processing of information in accordance with AADP’s Privacy Policy and these Terms and Conditions.

AADP processes your personal data for each transaction/payment, as far as necessary, during the entire duration of the business relationship as well as in accordance with the mandatory record retention as required by the law.

As part of our KYC process, you must provide us with all personal details that are necessary to be recorded in our system to maintain the business relationship with you and also any additional data that we are required by the law to collect or by the requirement of our correspondent banking agents. If you do not provide us with such data, we cannot proceed further with your membership registration or execute any payments or transactions. 

By accepting this terms and conditions you are confirming that you are consenting to AADP for recording/processing your personal data for the following purposes:

  • To record your personal details in our system for our KYC/due diligence purposes;
  • To process your transaction with basic personal details, through data processors and correspondent/intermediary banking agents;
  • To provide additional details to correspondent/intermediary banking agents, when requested;
  • To provide your KYC information to Law Enforcement Agencies/Financial Regulators, when requested;
  • To store your transaction details and KYC information at warehouses for record retention purposes.
  • To provide you with AAW-related marketing communication from time to time.
  • To fetch your account details/personal data from Al Ansari Exchange as well as to be shared to third-party service providers if required.

 

4.27 Assignment

AADP has the exclusive right to assign or transfer its rights and obligations under the terms to anybody or any entity of its choice in whole or in part and in such manner and on such terms and conditions as AADP may decide. Any such assignment or transfer will conclusively bind you and all other persons. You are not entitled to assign or transfer any of your rights and obligations under these Terms and Conditions to any third party without prior written consent of AADP.

 

4.28 Indemnification

You agree and undertake to fully indemnify and hold harmless AADP, its affiliates, service providers, subcontractors, and agents, and to hold each of the aforementioned parties harmless, from and against all liabilities (including settlement sums), losses, charges and expenses (including legal fees and disbursements on a solicitor-client basis), claims, demands, actions and proceedings which AADP, its affiliates, service providers, subcontractors and agents may incur, suffer or sustain directly or indirectly from or by reason of or in relation to the use, misuse or purported use or misuse of AADP, and will pay such monies to AADP upon its demand.

 

4.29 Variation in Terms and Conditions

AADP may, by notice through AAW or by such other method of notification as it may designate (which may include notification by way of email), vary these Terms and Conditions, whereupon such a variation will take effect on the date specified by us (which will generally be no less than thirty (30) Calendar days from the date of the notice). If you use AAW, including any new services after such date, you are deemed to have accepted such variations and such amended Terms and Conditions will be binding on you. If you do not accept the variation, you must stop using AAW. AADP has the right to vary these Terms and Conditions in the manner aforesaid without the consent of any person or entity who is not a party to these Terms and Conditions. 

 

4.30 Illegality

If at any time any provision of these Terms and Conditions is or becomes, invalid or unenforceable in any respect, the legality, validity and enforceability of the remaining provisions of these Terms and Conditions will not be affected or impaired thereby and will continue in force as if such illegal, invalid or unenforceable provision were severed therefrom. Waiver of any of the covenants to be performed by you or any breach by you will not be construed to be a waiver of any succeeding breach by you or of any other covenant. Our rights and remedies in these Terms and Conditions are cumulative and not exclusive of any other rights or remedies provided by law.

 

4.31 Notice

4.31.1 Communication from Al Ansari Wallet

You hereby authorise AADP to send promotional messages from time to time through various channels like Push Notifications, SMS, and/or email. AADP is entitled to send you notifications related to your access and use of the AAW App, as well as updates on related services. 

4.31.2 Communications through electronic means

Electronic delivery may occur via email, as an attachment, or through a downloadable content from the AADP. AADP will be deemed to have fulfilled its legal obligation to deliver to you any document if such document is sent via electronic means. Failure to advise AADP of any difficulty in opening a document so delivered within twenty-four (24) hours after delivery will serve as an affirmation regarding the acceptance of the document. 

Alerts sent via SMS will only be directed to your registered mobile number. All communication by AADP will be in English and Arabic and will be sent to your email address as per our records or through electronic services, mobile or other electronic media. When necessary, AADP may also communicate through press, radio, television, the internet, or any other media at its discretion. Any communication from AADP to you will be deemed to have been received by you and complete:

  1. If sent by email – at the time of sending to your email address.
  2. If sent by electronic services – at the time it was sent.
  3. If made through the press, radio, television or internet – at the time it was made.
  4. If made over the mobile application – at the time of publishing.

4.31.3 Feedback and Complaint Mechanism

Customers can contact AADP through the Contact Us page in the AAW App, our call center at 600506005 or email at [email protected] for registering feedback or complaints. AADP reserves the right to investigate complaints regarding the use of AAW or reported violation of these terms and to take any action deemed appropriate, including, but not limited to reporting any suspected unlawful activity to law enforcement officials, the appropriate authorities or regulators and disclosing any information necessary or appropriate to such officials, authorities or regulators, whether located in the UAE or outside the UAE.

 

4.32 Governing Law and Jurisdiction

These Terms and Conditions for the AADP shall be governed by and construed in accordance with the Federal laws of the UAE. Any disputes arising out of or in connection with these T&Cs will be settled by the exclusive jurisdiction of the Dubai courts.

 

4.33 Vendor/ Service Provider:

For Terms & conditions of AADP’s vendors/service providers, please refer to T&Cs on their websites & any other channels such as social media, information and promotion issued from their end.

5. Electronic Signature

Electronic Signature (hereinafter referred to as ‘eSignature’) shall have the meaning ascribed under Federal Law No. (1) of 2006 On Electronic Commerce and Transactions or its subsequent amendments thereto. The following terms and conditions apply to your use of eSignature across the application/platform.

  1. By ticking “You agree with the above-mentioned terms and conditions,” you are electronically signing these terms. This action signifies your consent to be legally bound by them and your approval for AADP to obtain and disclose information about you as outlined in these terms. Your eSignature is considered the legal equivalent of your handwritten signature, recognised by all authorities and bank documents, whether in the UAE or outside of the UAE.
  2.  To fetch your account details/personal data from Al Ansari Exchange as well as to share to third party service providers if required.
  3. You further agree that using a keypad or other device to select an item, button, icon, or similar action, or to provide information to AADP, constitutes your signature, acceptance, and agreement. This applies to any transaction, agreement, acknowledgment, consent, disclosure, or condition with AADP or a third party using the AADP system, as if you had signed with a pen.
  4. You also agree that no certification authority or other third-party verification is necessary to validate your eSignature and that the lack of such certification or third-party verification will not in any way affect the enforceability of your eSignature or any resulting contract between you and AADP.
  5. By agreeing to the terms and conditions, you confirm your opt-in to receive Push Notifications, SMS, phone calls and email communications from AADP. These communications may include transactional, promotional, and marketing material about our products and services. You will have the option to opt out of our promotional and marketing communications at any time. To opt out, you may contact us at [email protected] or call 600506005.
